This Agreement contains the complete terms and conditions that applies to an
individual or entity's participation in the services supplied by E-Hosting Provider (www.ehostingprovider.com) here forth called "THE COMPANY".
In this Agreement "we/us/our" means The Company; it's affiliates and partners.
"You" means the individual or entity applying for services.
"Site" means a world wide web site and, depending on the
context refers to either the www.ehostingprovider.com web site or your web site. If you do not
agree to this Agreement, you will not be entitled to use any of the
services offered on this site. We reserve the right to update and change
the terms and conditions in this Agreement at any time and it is your
responsibility to remain informed. This agreement will be governed by
the laws of South Africa, without reference to rules governing choice of
laws.
Our failure to enforce your strict
performance of any provision of this Agreement will not constitute a
waiver of our right to subsequently enforce such provision or any other
provision of this Agreement.

Application |

You
must first agree to the this Agreement and all terms and conditions expressed herein. Fill out
and complete the application form in full - all details must be
correct. You will be e-mailed with an invoice that may be paid via Paypal. |

Restrictions |

Restrictions
include, but are not limited to the following:
- You may not assign this Agreement under any
circumstances without our written permission. This Agreement will be
binding on, inure
to the benefit of and be enforceable against the parties and their
respective successors and assigns.
- You must be of a minimum age of 18 years to participate in our services.
- Any misuse of The Company's resources that disrupts the
normal use of the system is strictly prohibited. Such system abuse may
lead
to termination of the account without notice. You will also be held
responsible and liable for any and all damages that results
from such abuse. Examples of such abuse include, but are
not limited to, consuming excessive amounts of main memory or CPU
for long periods of time, spawning many processes that
consume resources etc. Any attempts to penetrate The Company's
security by password filtering, mining hacking etc. will
result in the termination of your account (s) without notice or refunds,
as
well as notification of the appropriate law-enforcement and
government agencies.
- Please ensure that your scripts are secured - any spam sent through unsecured scripts will result in account suspension.
- We reserve the right to ban use of certain scripts and programs known for being exploited. See our legal section for a list of such scripts.
- You may not use our Communication Services to send and
distribute unsolicited e-mail, bulk or mass e-mails, maintain maillists or engage in any
form of
spamming or pyramid schemes.
- You may not force any header information in any electronic posting or e-mail.
- Harassment
of other individuals utilizing the Internet after being asked to
stop by those individuals, a court, a law-enforcement agency and/or
The Company are strictly prohibited.
- Impersonating another user or otherwise falsifying ones
user name for fraudulent purposes in e-mail, Usenet postings or with any
other Internet
Service are prohibited.
- In
addition a fine of USD50 - 00 per offence, plus damage
liabilities, are applicable.
- You may not use any device, process or mechanism to
monitor, retrieve, search or access the Site or any material without our
prior written
consent.
- You may not misrepresent yourself, your affiliation with any third party or your entity.
- You
may not commit any form of electronic fraud.
- You may not upload any material containing viruses or any other material that is harmful.
- You remain responsible for the security of your username and password. Please notify us if any of these have been
compromised.
- You may NOT allow anyone other than yourself to use your login details to gain access to privileged content.

Fees
are payable as agreed upon within agreements, as applicable by
law and as per invoice.
ALL FEES PAID TO THE COMPANY ARE NON-REFUNDABLE AND
NON-TRANSFERABLE.

We reserve the right to interrupt service periodically, and without notice, for maintenance. |

You agree that we will send you e-mails from time to time letting you know about updates and other info. |
